RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK AND INDEMNITY AGREEMENT, BY SIGNING THIS AGREEMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF THE OCCUPIERS’ LIABILITY ACT OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT

PLEASE READ CAREFULLY!

Nature of Agreement:

You are obtaining solely a bailment that allows you to use the car as permitted by this agreement, you acknowledge that this car is owned by CW Royalty Group Inc, No one other than CW Royalty Group Inc may transfer the car or any rights or obligation. Under this agreement, any attempted transfer or sublease of the car by anyone other than CW Royalty Group Inc is void.

WE DO NOT MAKE NO EXPRESS OR IMPLIED WARRANTY INCLUDING ANY WARRANTY OF MERCHANTABILITY OR THAT CAR IS FIT FOR ANY PARTICULAR PURPOSE.

In this agreement, the customer means both the renter and the additional driver(s) as listed on the rental agreement.

• Vehicle is the property of CW Royalty Group Inc and is in good condition. Customer will return the vehicle, together with all tires and equipment in the same condition, to the location and on the due back date specified or sooner upon demand by the CW Royalty Group Inc. No express or implied warranty is made as to the roadworthiness of the vehicle and equipment or fitness for any purpose.
• Customers will reimburse CW Royalty Group Inc for all loss or damage to the vehicle (regardless of fault).
• The vehicle may not be used (prohibited use):
  1. By any person not listed on the rental agreement
  2. To transport people or property for hire, or to propel or tow anything.
  3. In any race, speed-test, contest, or in a reckless, abnormal, or abusive manner.
  4. By anyone under the influence of alcohol or other intoxicants, such as drugs; or by anyone driving in a state of drowsiness.
  5. By any person who has given false name, age, address or other false or misleading information.
  6. For any illegal purpose such as illegal transportation of persons, drugs, or contraband.
  7. To transport explosive or radioactive materials.
  8. Customer agrees that if the vehicle is obtained through misrepresentation or used for purposes contrary to the agreement herein, it shall be conclusively deemed that use or possession of the vehicle is without the permission of CW Royalty Group Inc. and in breach of this agreement.
• Any claims against CW Royalty Group Inc. of any nature whatsoever by the customer, authorized driver or any third party shall be limited to the lessor of The minimum statutory limit imposed by the relevant Canadian province and/or state, Any damages imposed by law.
• Customer agrees to be personally responsible for all losses or damages as a result of allowing an unauthorized person to operate or be in possession of the vehicle. All authorized drivers must be at least 18 years of age, be properly licensed for the vehicle, and have a minimum of 12 months of driving experience, unless otherwise consented to in writing by CW Royalty Group Inc..
• Anyone authorized by this agreement to operate the vehicle is subject to all terms and conditions.
• The renter acknowledges that he/she has provided insurance slip. The renter confirms OPCF 27 is included in their insurance policy.
• CW Royalty Group Inc. is not responsible for any damage to or loss of customer’s or anyone else’s property left in the vehicle or in any other vehicle on the CW Marine premises.
• Customers grants CW Royalty Group Inc. a limited power of attorney to present insurance claims for property damage to the customer’s insurance company, if the rented vehicle is damaged during the course of this agreement, and to endorse the customer’s name on insurance payments for rental charges or damages.
• CW Royalty Group Inc. WILL NOT BE RESPONSIBLE FOR ANY PERSONAL INJURY TO THE DRIVER AND THE PASSENGER.
• YOU ACKNOWLEDGE TO AUTHORIZE YOUR CREDIT CARD TO REPLACE ANY PARTS DAMAGED DURING RENTAL AT THE FULL RETAIL VALUE, IN CASE OF ANY PROHIBITED USE YOUR ENTIRE DEPOSIT WILL BE CHARGED.
• PERSON INJURY AND PROPERTY DAMAGE: TO THE EXTENT ALLOWED BY LAW, CW Royalty Group Inc. DOES NOT PROVIDE ANY LIABILITY PROTECTION FOR PERSONAL INJURY AND PROPERTY DAMAGE TO OTHERS CAUSED BY OPERATION OR USE OF THE VEHICLE.

FOR PARTICIPANTS OF MINORITY AGE, I HEREBY CONSENT THAT I, AS PARENT/GUARDIAN WITH LEGAL RESPONSIBILITY FOR THIS PARTICIPANT OF MINORITY AGE, DO CONSENT AND AGREE, TO HIS/HER RELEASE OF ALL THE RELEASEES, AND, FOR MYSELF, MY HEIRS ASSIGNS AND NEXT OF KIN, I RELEASE AND AGREE TO INDEMNIFY THE RELEASEES FROM ANY AND ALL LIABILITIES INCIDENT TO THIS PARTICIPANT OF MINORITY AGE’S PARTICIPATION IN THE ICE HUT ACTIVITIES OR ATTENDANCE AND/OR USE OF THE FACILITIES.

I understand that as the participant who signed this document, I also represent other participants who board the watercraft that I operate. Every participant have read, understood, acknowledged and agrees to the Liability Waiver and Rental Policy.

I AM AWARE OF THE RISKS, DANGERS AND HAZARDS ASSOCIATED WITH THE BOATING ACTIVITIES. I AND MY PARTICIPATING GROUP OF INDIVIDUALS FREELY ACCEPT AND FULLY ASSUME ALL SUCH RISKS, DANGERS AND HAZARDS AND THE POSSIBILITY OF PERSONAL INJURY, DEATH, PROPERTY DAMAGE AND LOSS RESULTING THEREFROM.

I HAVE READ AND UNDERSTAND THIS RELEASE AGREEMENT AND POLICY. I AM AWARE THAT BY SIGNING THIS AGREEMENT I AM WAIVING CERTAIN LEGAL RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS, PARTICIPATING INDIVIDUALS IN MY GROUP, ASSIGNS AND REPRESENTATIVES MAY HAVE AGAINST THE RELEASEES.
